A Law Purposely Designed To Allow Profiling & Selective Prosecution
I'm going to approach this from a "Law Design Perspective" and not the "Racism" perspective.
If a law allows the benefit of the doubt to determine whether or not an arrest is warranted, then the law must ensure no ambiguity exists.
If a police officer is forced to make a decision associated with choosing whether or not to arrest a person based on the officer's thoughts, or his experience in the field, when assessing the disposition of a shooting incident, then there is ambiguity.
If a district attorney has the option to choose whether or not to accept "The Stand Your Ground Defense" based on the description of the law that leaves the decision to 1 individual, then there is ambiguity.
If a jury is tasked with accepting or denying The Stand Your Ground plea based on the evidence presented in a trial, then there is ambiguity.
The Law must be clearly defined to such a degree that 9 out of 10 people would interpret that law the same..., and not similarly.
A Police Officer may be prejudice, thus, he isn't allowed to decide.
A District Attorney may consider her/his work load as part of the deciding factors to allow a law to be accepted, which doesn't ensure equal justice for all.
A Jury is allowed to decide whether or not to allow the "Stand Your Ground Law" to be accepted based on the evidence presented during trail, even if specific information was with held, information was lost, or information just wasn't available during trial, then justice can't be served.
The Stand Your Ground Law is flawed because it isn't clearly and specifically defined to the required degree. Allowing a police officer to choose, allowing a DA to choose, or allowing a jury to choose, which instance that would allow each party level to decide whether the law is applicable, opens the door to some degree of possible flaw based on the level of the group's interaction with their assigned responsibility.
The Entities that participated in the designing of this extremely flawed law know exactly what the flaws are in this law, and they also knew how this law could be implemented by a specific group of people.
My Allegation is that this law was purposely designed to cause the exact results that it has produced.
Stand Your Ground Law need to be removed in totality.
